Mortgage deed

Mortgage deed

If you want to buy a house, you may need to finance this by taking out a loan with a loan provider, such as a bank or other lender. The arrangements you make with the loan provider, will, amongst other things, be laid down in a mortgage deed. This deed will then be executed by the civil-law notary, after which you and a person authorised to sign on the loan provider’s behalf, will sign the mortgage deed.

Provisions

Reference in the mortgage deed is made, for example, to:

  • the buyer(s) and the loan provider
  • the loan
  • the mortgage creation
  • the pledge
  • the loan provider’s most important general conditions
  • the surety provision by the National Mortgage Guarantee (NHG), if applicable
  • the details of the interpreter, who also signs the deed
